Arthur William Rohr, Personal Representative for the Estate of Arthur Rohr v. R.J. Reynolds Tobacco Company was tried in the Circuit Court of the 17th Judicial Circuit in and for Broward County, Florida. Arthur Rohr was 85 years old when he died of cancer of the lung and other complications that Plaintiff alleges were caused by smoking. Mr. Rohr began smoking as a young adult and chose to continue smoking for at least 50 years. This matter was filed as an Engle progeny case seeking to have all of the relevant legal findings associated therewith applied. In the second phase of the trial, after two days of deliberations, the jury assigned 100% of the fault for his injuries to the smoker based on his conscious, controlled and voluntary decision to smoke despite full knowledge of health risks and potential consequences. No appeal was taken from this jury verdict.
