CASE RESULTS DEPEND UPON A VARIETY OF FACTORS UNIQUE TO EACH CASE. CASE RESULTS DO NOT GUARANTEE OR PREDICT A SIMILAR RESULT IN ANY FUTURE CASE.

U.S. District Court, Minnesota, 1995 [105 F.3d 387]

Our client, American President Lines, asked Richard Morgan to step in for the retrial of this breach of contract matter involving alleged mishandling of a shipment.  The first trial, in which Bowman and Brooke was not involved, resulted in Gamma-10 receiving a jury verdict for $500,000 in its favor.  The case was remanded by the Eight Circuit, who ruled that the plaintiff had been improperly denied the opportunity to seek punitive damages.  The re-trial produced a complete defense verdict for client American President Lines, which was upheld by the Eighth Circuit on appeal.
