This contract matter involved Ecolab’s arrangement to use the services of Atkinson for its warehousing needs in the Washington, D.C. area. At issue was whether the arrangement was a binding contract and whether it allowed for termination of the contract on 60 days notice, orally or in writing.
Richard Morgan was asked to first-chair this trial, after prior counsel recommended settlement. The week-long trial resulted in the jury awarding plaintiff less than a quarter of its settlement demand.
