The Texas Supreme Court granted Kia’s petition to review a case alleging that the airbags in a Spectra failed to deploy in a car crash. The airbags passed the applicable federal safety standards, but the Fifth District Court of Appeals in Dallas found Kia to be 45% at fault.
The Texas Supreme Court will hear whether the Fifth District Court of Appeals erred when it awarded actual damages against Kia.
