Vanden “Van” Nibert concentrates his practice on defending clients in high-stakes commercial disputes involving consumer class actions, mass torts, breach of contract, unfair trade practices, construction defects and product and premises liability at both the trial and appellate levels. He represents clients in a variety of industries including financial services, healthcare, energy and construction.
Van has represented corporate clients in state and federal courts and regulatory agency proceedings across the country. Van is trusted to oversee trial teams and handle all stages of litigation. He is experienced in managing all aspects of discovery, drafting pleadings, dispositive motions and briefs, as well as representing clients in alternative dispute resolution proceedings. He has also assisted clients with internal, regulatory and criminal investigations and overseen risk management processes.
In a two-week bench trial, Van successfully defended a large financial institution against claims alleging a multimillion-dollar, international wire fraud scheme. In another matter, Van drafted trial-level and appellate briefing on behalf of a major healthcare institution in a high-leverage, putative class action alleging breach of contract, among other claims, that resulted in a complete dismissal of the suit. He also defended a natural gas storage company in civil, criminal and investigative proceedings by various state and federal environmental regulators stemming from a stray gas incident.
Van also maintains an active pro bono practice focusing on child advocacy and representing veterans and prisoners in First Amendment and other rights-based matters.
When not in the office, as a new parent, Van enjoys spending time on the lake or in the mountains with his wife and their son.
