Nathan Marcusen focuses his practice on product-liability and class-action defense and commercial litigation. Comfortable in any venue or forum, Nathan has litigation experience in 30 states, handling all aspects of complex litigation—from discovery and Daubert hearings through to trial and appeal.
Whether fending off a putative class action or defending against catastrophic personal-injury or property-damage claims, Nathan aggressively defends the integrity, utility, and safety of his client’s products. With over a decade of products-litigation experience, he has represented manufacturers across a wide range of industries, including automobiles, recreational and off-road vehicles, consumer products such as power tools and sports equipment, commercial cleaners and pesticides.
Nathan also regularly handles complex commercial matters. Representing clients whose needs vary considerably—from Fortune 500 companies to small businesses and sole proprietorships—he has litigated and arbitrated claims for misappropriation of trade secrets, breach of contract and warranty and breach of fiduciary duties.
When not preparing cases for trial, Nathan regularly consults on legal strategy and advanced motions, emphasizing the potential for judicious motions practice to narrow the issues, reduce exposure, and foster early resolution. He also handles all aspects of appellate litigation, from issue preservation and appellate strategy through to briefing and oral argument.
Outside of the office, Nathan serves on the Legal Assistance to the Disadvantaged Committee of the Minnesota State Bar Association. He enjoys taking in the outdoors at his parents’ farm, reading biographies and fiction and traveling with his wife, Emily, and three young children, Anna, Owen and Clara.
