Children and Product Liability

At Bowman and Brooke, we take pride in more than 20 years of defending thousands of products liability claims. Combining our trial-focused training and case-management experience, we have a team of skilled lawyers to handle cases involving child plaintiffs and children’s products.

The plaintiffs’ bar often targets product-related cases involving children because these cases are tragically sympathetic and high-profile, and the potential damages astronomical. We are committed to defending product manufacturers in these cases because we recognize that an allegation against a manufacturer not only has significant financial impact, but also involves risk to the organization’s reputation. These cases can easily become “bet the company” cases.

Experience
With a team of highly skilled, risk management, trial and appellate attorneys, we focus on defending product manufacturers in personal injury claims involving infants, toddlers, children and teens. Knowing that we are prepared to vigorously defend cases involving claims of negligence, strict liability, breach of warranty and failure to warn allows our clients to do their job—create new products.

From the beginning, we have represented various clients across the country in cases involving injuries to children. We have defended manufacturers of typical child and juvenile products (strollers, furniture and toys). We also defend manufacturers of products not specifically designed for children (cars, chemicals, sports equipment, automobiles, drugs, medical devices and recreational vehicles), but which have been alleged to have caused injuries to children of all ages.

Knowledge
We understand that the relationship between products and children present special challenges to traditional products liability case management and defense. Our team focuses on the needs of our clients by providing:

  • Product experience: As a products boutique, we understand the public perceptions and expectations regarding the responsibility of product manufacturers. Our lawyers have defended many child cases in defense of numerous industries. A common attack against products not specifically designed for children is that they should have been designed with children in mind. Our lawyers have the experience and background to address this head on and to get the whole story out in a strategic manner.
  • Product Warnings: Our experience with the impact and necessity of warnings is not only useful in the courtroom, but our attorneys also provide product warning advice for our clients. In addition to working with our clients to audit their internal practices, our attorneys provide counseling on product safety and liability prevention, including warnings, instructions, packaging, advertising and product literature.
  • Client Satisfaction: Because of our unique focus, we are efficient and cost-effective. We provide our clients with an early evaluation program that is designed to provide the facts and recommendations necessary to decide whether a case is a trial or settlement candidate. This enables them to save substantial time and money, while making strategic, long-term business decisions. Should the decision be a trial on the merits, we can provide a confident team and seasoned trial veterans.

Trial Strategy

We handle cases irrespective of their size or exposure from filing through verdict and post-trial appeals. We also defend the products in one-time or pattern litigation, with cost effective and goal-oriented case plans. In addition, we serve as national counsel for a number of manufacturers.

We not only defend children and products liability litigation, we promote child product safety in the communities where we work and live. Committed to child product safety, we sponsor a national organization which provides free of charge, effective and easy-to-understand product guidelines in English and Spanish for parents and caregivers. We are members of the Product Liability Advisory Council, International Play Equipment Manufacturers Association and DRI’s Children’s Products Group. In addition, our attorneys visit local schools to teach product and child automotive safety. Finally, as parents, many of our attorneys are on the front line of child issues and child safety.
